Article 1: Definitions
Apollo Gym values clarity and transparency with its members. This contributes to a positive and safe atmosphere in our gym. By becoming a member of Apollo Gym, you agree to these Terms & Conditions and House Rules, which are available at www.apollogym.nl.
1.1 Promotion: a special offer provided to new members, where contract duration and price may differ from Apollo Gym’s standard memberships.
1.2 Chargeback/Collection costs: an administrative fee charged in case of failed or late payments.
1.3 Absence: when a member cannot attend training sessions for any reason.
1.4 Contribution/Membership fees: the amount payable for a membership.
1.5 Member: a natural person aged 14 years or older who registers with Apollo Gym.
1.6 Financially responsible person: the person responsible for payment of the membership fees.
1.7 Family members: members living at the same residential address and registered under a family membership.
1.8 Upgrade: a change to a higher membership type with extended value or duration.
1.9 Activation/Administration fee: the one-time cost for activating a new membership.
1.10 Membership: the agreement between the member and Apollo Gym created upon registration.
1.11 Lockers: storage units provided to keep personal belongings.
1.12 Termination notice period: one full collection period payable when a member cancels.
1.13 Main payer: the member responsible for payment under a Family or “Together” membership.
1.14 Collection period: a full calendar month.
1.15 Personal guidance: general support from gym staff (equipment introduction, fitness tips). This does not include personal training sessions.
Article 2: Registration
2.1 You can register as a member of Apollo Gym via the online registration form on the website or the Apollo Gym app.
2.2 Registration via sports subsidy programs (e.g., Sportfonds) must be arranged at the reception desk.
2.3 After registration and payment, you may immediately start training.
Article 3: Access & Personal Data
3.1 Your personal data is registered in Apollo Gym’s administration upon registration.
3.2 By registering and completing the first payment, you authorize Apollo Gym to collect membership fees via direct debit.
3.3 Access is controlled via your membership card/tag at reception.
3.4 “Together” memberships allow joint or individual use of the facilities.
3.5 Personal data is processed strictly for the purposes of membership and gym access.
3.6 Personal data is never shared with third parties without consent.
3.7 Apollo Gym may use your contact details for gym-related communication.
3.8 A member’s photo may appear on the reception screen when checking in; visibility for other members cannot always be avoided.
Article 4: Membership, Duration & Payment
4.1 Membership begins at registration, for either a fixed term or indefinite term (depending on membership type), with a minimum of two full collection periods.
4.2 Fixed-term memberships automatically renew to an indefinite membership at current rates once the contract ends. After renewal, membership can be canceled monthly with one full collection period’s notice.
4.3 Flexible or Youth memberships can be canceled monthly with one full collection period’s notice.
4.4 Members under 18 require parental/guardian consent to register.
4.5 “Together” memberships require proof of living at the same address.
4.6 Payments are collected monthly by direct debit.
4.7 In case of a Family/Together membership, if payment fails for the main payer, Apollo Gym may collect from another associated account.
4.8 Failed direct debit payments will incur a €15 fee per failed transaction.
4.9 Non-payment constitutes default. Apollo Gym may determine when to terminate access or the contract.
4.10 In case of non-payment of a fixed-term contract (e.g., one, two, or three years), Apollo Gym is entitled to claim the remaining contract value. Additional collection costs and statutory interest will be charged.
4.11 Access to Apollo Gym may be denied until outstanding payments are made.
4.12 Family passes cannot be extended or upgraded. Upon expiry, they will convert to a “Together” membership.
Article 5: Fees, Promotions & Adjustments
5.1 Apollo Gym may annually adjust membership fees based on the Dutch CPI (Consumer Price Index).
5.2 Apollo Gym may also adjust fees due to increased costs (taxes, wages, energy, or other business expenses). Members will be informed at least one month in advance.
5.3 Members may cancel within 30 days of notification if they do not accept a price increase. If they do not cancel, the adjustment is deemed accepted.
5.4 Price adjustments due to government measures (e.g., VAT) may be applied immediately and do not entitle members to cancel.
5.5 Promotional terms may differ and are valid only during the promotion period.
5.6 No rights can be derived from past or future promotions.
5.7 Promotional discounts always apply before the official membership contract period begins.
5.8 Promotions related to new locations are valid only at that location.
5.9 Paid membership fees are non-refundable, unless required by law or explicitly agreed otherwise in writing.
5.10 Absence, for any reason, does not release members from payment obligations.
Article 6: Changes & Termination
6.1 Membership changes are possible only at the end of a fixed-term contract, unless upgrading.
6.2 An upgrade takes immediate effect; the new contract period starts on that date.
6.3 Termination must be submitted via the Apollo Gym app or by email (receptie@apollogym.nl). Termination is valid only after confirmation by Apollo Gym.
6.4 Temporary suspension of membership is possible only in cases of:
Relocation: if moving more than 30 km away from Apollo Gym (proof required). Early termination requires buy-out; fees will be recalculated based on the flexible membership rate.
Medical reasons: suspension for a maximum of 3 months may be granted. Apollo Gym reserves the right to request supporting evidence. The suspension extends the contract duration by the same number of months.
Government-mandated closures: memberships will be frozen during mandatory closures and resume automatically once restrictions are lifted. Contract duration is extended accordingly.
6.5 If the main payer of a Family/Together membership cancels, the membership is automatically transferred to another linked member.
6.6 Online registrations include a statutory 14-day right of withdrawal (“cooling-off period”).
6.7 Withdrawal must be submitted via the withdrawal form (website) or by email.
6.8 If the membership has not been used within the 14-day period, withdrawal is free of charge. If the facilities were used, Apollo Gym may charge proportional fees, including activation costs.
6.9 Terminations via fax, chat, social media, phone, or verbally will not be processed.
6.10 Apollo Gym may terminate membership immediately in cases of rule violations, misconduct, or unpaid dues. Repeat offenders may be denied re-registration.
6.11 Outstanding balances must be settled before termination is finalized.
6.12 Credits or unused services expire once membership ends.
6.13 Relocation of Apollo Gym:
If Apollo Gym relocates within 5 km, contracts remain unchanged.
If Apollo Gym relocates further than 5 km, members may cancel with one month’s notice.
Article 7: Risk & Liability
7.1 Use of Apollo Gym facilities is entirely at the member’s own risk.
7.2 Main payers of Family/Together memberships remain responsible for all associated payments.
7.3 Apollo Gym is not liable for personal injury or damage, except in cases of intent or gross negligence by Apollo Gym or its staff.
7.4 Lockers are provided free of charge. Apollo Gym is not liable for theft or damage to belongings. Own locks are not permitted.
7.5 Lockers left locked after closing may be opened by staff.
7.6 Members are responsible for ensuring their own physical suitability for training. Seek medical advice if uncertain.
7.7 Apollo Gym provides personal training and general fitness guidance. Members are responsible for how they apply advice or training.
7.8 Apollo Gym is not liable for damage or theft of vehicles parked on or near its premises.
7.9 Members are liable for damage caused to Apollo Gym property through negligence or misconduct.
7.10 Filming or photography of staff or members without prior consent is prohibited.
Article 8: Complaints
8.1 Complaints may be submitted to the reception desk or via email (receptie@apollogym.nl).
8.2 Please include your name, address, and details of the complaint. Apollo Gym will handle complaints promptly and fairly.
Article 9: Final Provisions
9.1 By registering, you acknowledge and accept Apollo Gym’s Terms & Conditions and House Rules.
9.2 These documents are available on www.apollogym.nl and at the reception desk.
