Article 1: DefinitionsApollo Gym considers it important to be clear and transparent towards our members. This contributes to a pleasant atmosphere in our gym. By becoming a member of Apollo Gym, you agree to these Terms & Conditions and our House Rules. You can find the Terms & Conditions and House Rules at www.apollogym.nl.
1.1 Promotion: an offer Apollo Gym provides to new members. Contract duration and price may differ from Apollo Gym’s standard offers.
1.2 Failed-payment fee (storno costs): a fee charged in case of a failed or late payment.
1.3 Absence: when you cannot come to train for any reason whatsoever.
1.4 Contribution / membership fee: the membership amount you must pay per month if you registered before 1 January 2023.
1.5 Member: a natural person aged 15 years or older.
1.6 Financially responsible person: the person who is financially responsible for the membership fees.
1.7 Family members: members who are family and live together at one address.
1.8 Upgrade: a change of membership whereby the value and the contract duration of the membership are increased.
1.9 Activation fee / administration fee: fees charged for activation upon registration.
1.10 Membership: the agreement entered into between you and Apollo Gym upon registration. These Terms & Conditions form part of the membership.
1.11 Lockers: a locker where you can store your belongings.
1.12 Notice period: one full collection period that Apollo Gym collects from you after you have cancelled your membership.
1.13 Main payer: the member responsible for payment under a Together membership or Family membership. The contribution is collected from the main payer’s bank account.
1.14 Collection period: a period of one full calendar month for members who registered on or after 1 January 2023.
1.15 Personal guidance: guidance by gym staff such as start-up advice, explanation of equipment and fitness tips; this is not a personal training session.
1.16 Minor: a person under 18 years of age.
1.17 Youth member: a Member aged 15 through 17.
1.18 Start-check: a mandatory introduction/safety instruction (including basic technique and equipment rules) by an Apollo Gym staff member, before independent training is allowed.
1.19 Supervised training: training under direct supervision of a parent/guardian or a supervisor/staff member designated by Apollo Gym (e.g., a youth class).

Article 2: Registration2.1 You can become a member of Apollo Gym by registering via the registration form on the Apollo Gym website or via the Apollo Gym app.
2.2 Registration via a sports subsidy fund (Sportfonds) can be arranged via reception at one of the Apollo Gym locations.
2.3 After registration you may start training at Apollo Gym immediately.
2.4 Registration of a Minor can only be completed once Apollo Gym has received the parent/guardian’s details (Financially responsible person) and a signed consent form.
2.5 Apollo Gym may ask for identification to verify age.
2.6 For Youth members: independent training is only permitted after the Start-check (see Article 3).
Article 3: Access and Personal Data3.1 After registration, your personal data will be recorded in our administration.
3.2 By registering with Apollo Gym and completing the first payment, you authorize Apollo Gym to collect the contribution by direct debit.
3.3 Your access to Apollo Gym is controlled by scanning your tag/card at reception.
3.4 With a Together Fit membership you may always train together, but also individually.
3.5 Your personal data is strictly confidential and will not be used for any other purpose than granting access to Apollo Gym.
3.6 Your personal data will never be provided to third parties.
3.7 When checking in, your photo appears on the reception screen for verification; this screen is intended for staff checks.
Youth policy
3.8 (Age policy): Apollo Gym applies a minimum age of 15 years for independent training in the fitness area.
3.9 (Under 15): minors under 15 may only train via Supervised training (e.g., youth class/intro) or under direct supervision of a parent/guardian, if Apollo Gym has approved this in advance.
3.10 (Start-check required): Youth members (15–17) may only train independently after completing the Start-check. Until then, Apollo Gym may restrict access to group classes or supervised training.
3.11 (Restricting access): Apollo Gym may impose additional conditions for Youth members (e.g., training only during staffed hours, or restrictions in zones/exercises) where necessary for safety and supervision.

Article 4: Membership, Term and Payment4.1 Your membership officially starts at the moment of registration for an indefinite or fixed term (depending on the membership you choose), with a minimum of two full collection periods.
4.2 If you have chosen an Unlimited, Together Fit, 3xPW, 2xPW, Off-Peak (Daluren) or other current membership, it will automatically be extended for an indefinite term after your contract ends. The membership fee will then be adjusted to the current fee of that membership. After this renewal, your membership can be cancelled monthly with a notice period of one full collection period, which starts after deregistration.
4.3 If you have chosen a Flex or Youth membership, your notice period is one full collection period, which starts after deregistration.
4.4 (Youth members 15–17): require consent from a parent/guardian. The parent/guardian is the Financially responsible person and is considered the contracting party for payment and administrative matters. Without consent, the agreement may be terminated/voided.
4.5 If you use a Together Fit membership, both members must be able to prove they live at the same address.
4.6 Payment for your membership takes place monthly if you registered before or from 1 January 2023.
4.7 If you use a Family Pass or Together membership and we are unable to collect the fee from the main payer, the fee will be collected from one of the bank accounts of the other (family) members linked to the main payer.
4.8 You must ensure that we can collect the contribution without issues. If this is not possible, we are forced to charge €15.00 in failed-payment fees per failed collection attempt.
4.9 If you have not paid your membership fee on time, you are automatically in default. We determine per incident at which point termination will take place.
4.10 In case of arrears for a fixed-term membership (for example one-, two- or three-year), Apollo Gym is entitled to charge the full remaining amount of the contract period. Any collection costs and interest are for the member’s account, in accordance with statutory rules. These costs may be from 15% of the amount due, with a minimum of €40.00.
4.11 If a Youth member does not comply with youth rules/safety instructions, Apollo Gym may (temporarily) restrict or suspend access. Apollo Gym will inform the Youth member and the Financially responsible person. If your contribution has not been paid on time, access to Apollo Gym is not possible.
4.12 You cannot extend or upgrade a Family Pass. The terms for a Family Pass apply only to current members with a Family Pass. When your Family Pass agreement ends, it will be converted into a Together membership. From conversion, the articles relating to a Together membership apply.

Article 5: Fees, Continued Payment, Promotions, Terms & Conditions5.1 Apollo Gym reserves the right to index fees annually based on the Consumer Price Index (CPI) published by Statistics Netherlands (CBS).
5.2 Apollo Gym may also adjust fees if there are demonstrably rising costs, such as increases in taxes, wages, energy prices or other substantial business costs. If Apollo Gym changes fees during a membership term, this will be communicated to the member in writing or by email at least one month before the effective date.
5.3 In that case, the member has the right to cancel the membership within 30 days of the announcement, effective from the date the price change takes effect. If the member does not cancel, the price change is deemed accepted.
5.4 Price adjustments due to government measures may be implemented immediately regardless of size and do not entitle the member to terminate the agreement.
5.5 For promotions and/or special offers, you can request the conditions at the Apollo Gym locations or via our customer service.
5.6 No rights can be derived from promotions and/or special offers, before or after.
5.7 Promotion periods are always applied prior to the membership unless we state otherwise. Promotion periods fall outside the contract term.
5.8 Promotions at a new location are only valid if you register at that new location.
5.9 Paid contributions are not refundable, unless there is a legal obligation or an explicit written agreement with Apollo Gym.
5.10 If you are absent for any reason, this does not release you from the obligation to pay the membership fee and does not entitle you to any reduction.

Article 6: Conversion / Cancellation6.1 If you want to convert your membership, this is only possible when your one-, two- or three-year membership ends, unless you want to upgrade.
6.2 In case of an upgrade and/or conversion, the start date takes effect immediately. From that moment, your new membership term starts.
6.3 If you want to cancel your membership, you can do so via the Apollo Gym app or by emailing receptie@apollogym.nl. After confirmation of our email, your cancellation will be processed.
6.4 Interim cancellation/freezing of a membership is only possible if:
Relocation: you receive a new residential address more than 30 km away (based on the shortest route) from one of the Apollo Gym locations. This is accepted only if you provide an official municipal registration document as proof. If approved, you must buy out your membership. For a one-, two- or three-year membership, your fees will be recalculated to a Flexible membership.
Medical reasons: if you temporarily cannot use your membership due to medical reasons, you may request to freeze the membership for a maximum of 3 full collection periods. You declare that there is a medical reason, without needing to provide medical data/documents. In exceptional cases Apollo Gym may request proof, such as a doctor’s statement. The freeze period automatically extends your contract duration by the same number of months.
Government-mandated closure: if the government decides there is a mandatory closure period, we offer the option to freeze your membership for the duration of the measure. Once lifted, your membership automatically continues. Your contract period is extended accordingly.
6.5 If you are the main payer of your Family Pass or Together membership and you deregister, the membership is automatically transferred to one of the other linked (family) members.
6.6 If you entered into a membership via the online registration form on the Apollo Gym website, you have a 14-day statutory right of withdrawal. This period starts on the day you conclude the membership.
6.7 If you decide to withdraw, you can do so by completing the withdrawal form on the website or by email to receptie@apollogym.nl.
6.8 If you withdraw and you have not used the membership during these 14 days, the withdrawal is free of charge. If you have used the membership, Apollo Gym may charge costs pro rata (from activation up to the day of withdrawal, including any activation costs).
6.9 Cancellations sent by fax, online chat, social media, phone, or verbally will NOT be processed.
6.10 If you do not comply with the agreement, our house rules, or you display inappropriate behaviour as indicated by gym staff or the gym manager, we may deny you access to Apollo Gym and terminate your membership immediately. The assessment of this behaviour is solely reserved to Apollo Gym. Re-registration may be terminated again on the same grounds.
6.11 If you have outstanding amounts, these must be paid before you can terminate your membership.
6.12 Any credits can no longer be used after termination of membership.
6.13 Relocation of Apollo Gym
If Apollo Gym relocates within a radius of 5 km from the current location, membership conditions remain unchanged and this does not entitle members to interim cancellation.
If Apollo Gym relocates to a location more than 5 km from the current location, the member has the right to terminate the membership free of charge with a notice period of one full collection period.
This termination right applies only if the relocation significantly impacts travel distance and accessibility for the member.
Members wishing to terminate for this reason must submit a written request within 30 days after the official announcement via receptie@apollogym.nl.
If a member uses a Together Fit or Family membership, this termination right applies only to that individual member and not automatically to linked members.

Article 7: Risk and Liability7.1 Training at your own responsibility
Training and the use of Apollo Gym facilities involve inherent risks. Apollo Gym takes reasonable measures to provide a safe training environment, including maintenance, house rules and basic instruction. Members remain responsible for training within their own capabilities and for following staff instructions.
7.2 Liability of Apollo Gym
Apollo Gym is not liable for any injury, loss or damage suffered by a member or visitor, unless such damage is caused by an attributable failure or an unlawful act by Apollo Gym (for example negligence). Liability cannot be excluded where damage results from intent or gross negligence by Apollo Gym or its staff.
7.3 Personal belongings and lockers
We advise members not to bring valuables. Apollo Gym provides lockers to reduce the risk of loss, theft or damage. Apollo Gym is not liable for loss, theft or damage to personal belongings, unless such loss or damage is caused by intent or gross negligence by Apollo Gym.
An Apollo Gym padlock costs a one-time fee of €8.00. Using your own lock is not permitted. Apollo Gym may remove or cut open locks left on lockers after closing time so that lockers are available again the next day.
7.4 Health and fitness suitability
Members are responsible for assessing whether they are physically able to train. If you are unsure about your health or physical condition, Apollo Gym advises you to consult a doctor or specialist before training.
7.5 Guidance, training advice and personal training
Apollo Gym staff may provide general guidance and fitness tips. Apollo Gym also offers personal training services. Members remain responsible for how they apply any advice, guidance or training programs and for the choices they make during training.
7.6 Youth members (15–17 years)
Youth members must complete the Start-check and comply with youth rules and staff instructions. If safety requires it, Apollo Gym may restrict access to certain exercises, equipment, zones and/or training times, including limiting training to staffed hours.
7.7 Vehicles and other transport
Apollo Gym is not liable for damage to and/or theft of vehicles or other means of transport parked on or near Apollo Gym premises, unless such damage results from intent or gross negligence by Apollo Gym.
7.8 Damage to Apollo Gym property
Members are liable for damage to Apollo Gym property if such damage is caused by their negligence, fault or misconduct.
7.9 Audio/video recordings
Members and visitors are not permitted to make or publish audio and/or video recordings of staff or other members without prior consent.
Article 8: Complaints Procedure8.1 If you have complaints, we find that unfortunate, but we would of course like to hear about it. You can contact our customer service via the Apollo Gym website, report it at reception, or email receptie@apollogym.nl.
8.2 Please include your name and address details and a description of the complaint. We will ensure proper handling of the complaint.

Article 9: Final Provisions9.1 By registering, you declare that you know, accept and will act in accordance with the Terms & Conditions and House Rules.
9.2 The Terms & Conditions and House Rules of Apollo Gym can be found on the website and can be requested at the front desk.
